After the ordeal with the State Police, I am still somewhat shocked about the behaviour of the Martinsburg West Va. City Police, or I guess I should say one of them.
I and my fiancee had the great priviledge of being pulled out of a returant to search our car for what they said appeared to be "2 smoking devices" which one turned out to be a cologne bottle, and I never found out what the second one was. But, the humiliation was unexplainable. I will post more later, including a copy of my formal complaint.
Police misconduct is running rampant, and there really needs to be something done about it! There has to be some kind of organization that looks into these matters.
Is this what they call "Homeland Defense"? Rule by terror?

Amber keep us up to date. Its always interesting how the police tend to do what they want after they claim they SAW something in your car. They dont know what it is but a smoking device must be POT of course..LOL

I think cops used to be better but over the last 15 years, since "Cops" made it big on television, seems their industry is scraping the bottom of the scum barrel.

In Louisiana cops have been known to plant drugs if the police chief fancies your automobile. They like it, they own it and innocent you go to jail.

Female cops are the absolute worst of the lot. Consumed with penis envy, and wanting to get even with the world for not having one themselves, they're far more dangerous and deadly then most male cops.

Thank you! I am sending it now. It is the same story, but hopefully you can post it so people can actually read it. I wrote it in "word document" it looked fine until I submitted it, I tried changing it, but it did not work.

Here it is

On April 3, 2008 I and my fiancee went to the Shoneys resturant in Martinsburg West Virginia.



As we pull into the parking lot, we observe a Martinsburg City Police car parked beside the building, We pulled up to the front of the resturant,(I was a passenger). The Police car came around and pulled in beside us. We were finishing our cigarettes before going in, and my fiancee told me, That cop is just sitting there staring at you. I put out my cigarette, and turned to exit the car. At this time the female officer (Kristal Barrett) opened her door as if to trap me in the car,as she exited hers, she was staring at me hard. So, I asked her "Are you trying to talk to us?"( I knew we had done nothing wrong.) Her reply was,"I don't know what the hell you got going on here, but didn't you call me?" I replied,"No maam!" At that point the night manager (Ellen) who was standing on the sidewalk, said " No maam I called you, I am the manager here, Someone hit one of my employees car over there, that WHITE Pontiac. The manager then turned to me (still seated in the car) and apologized, saying "I'm sorry, am I blocking you?" I replied that's o.k., (as I was still trying to get out of the car) The officer was just standing there looking at me, and not really wanting to get out of the way. Ellen had to basically coax the officer out of the way, (so I could get out of the car) saying, "It's This car over here, These people just pulled in."

My fiancee and I went into the resturant and proceeded to try to have a nice dinner. Ater about ten minutes the manager came back in and apologized again for the officers rudeness saying, " I don't know what that was all about, I saw her staring at you when she pulled in, I thought she knew you or something, then when she said that, I really didn't know what to think. But I do apologize, because I called them. I replied " that's o.k.,(and jokingly) It happens all the time." She proceeded to tell me that the officer seemed more interested in our car than the one that got hit. I just laughed it off and proceeded with our meal.

A little while later another employee came to our table and said, "That lady cop is out there all over your car looking in it and everything." I once again laughed it off saying, " Maybe she is thinking about buying one." and proceeded trying to have a good meal.

A little while later, another employee comes to us and said " I just thought you might like to know, those cops are out there looking in your car."

I had then had eneough, (Knowing that we had done, and were doing nothing wrong) I left my meal and went outside....

The officer was just getting into her car,(parked beside ours) I politely asked the officer "is there a problem with our car, or is there something inside you would like to look at?" She replied " I do not know what you are talking about sir, why would you come out and ask me that?" I replied " Because I cannot enjoy my meal without the harassment of everyone telling me that you are so interested in my car. So I just wanted to know if there was something I could help you with, so we can enjoy our meal." At this point the officer jumped out of her car with her hand on her gun,mace,stick,( i'm not sure what device of torture she was grabbing at) saying, "Sir, I don't know what you are talking about, but, if you do not want to get into big trouble, you need to go back inside now!" Without saying one word, I complied, wandering just what kind of big trouble I was supposed to be getting into.(Still knowing we had done nothing and were doing nothing wrong.)
Thinking that was the end of everything, although being slightly frazzeled, I continued to try to enjoy my evening and my meal.

A little while later, the manager came to us and informed me that some officers wanted me outside. At that time I told Her," You are my witness, I am sitting here trying to enjoy my meal, I am doing nothing and have done nothing wrong. This is harassment. She replied "I agree, I do not know why they want you, but they want you outside, I am so sorry!

I arose to go outside, and there stood the female cop and a male officer in the middle of the returant. I approached them and asked "what is the problem officer?" He said "Are you the owner of that green pontiac out front?" I replied "no sir." he then said,(after a moment of hestation) "were you a passenger in that car earlier? I replied "yes sir." He then informed me, "There appears to be two smoking devices in that car." I just looked at him blankly. He then asked me "Do we have your permission to search the car?" I replied, "No, I cannot give you permission to search it, because it is not mine." He then informed me, " Well, there appears to be two smoking devices in that car, that gives us propable cause to search the car. you have admitted to being a passenger in the car, so you are liable for anything in there. You need to come outside with us and stand by while we search the car. (Now I do not know a whole lot about "policing", but I do believe proper procedure would have been to inquire as to who the owner of the vehicle was, and/or if they were present or not.) At this point I believe I was experiencing or coming very close to an anxiety attack. Still knowing I had done and was doing nothing wrong. And definetely knowing there was no "smoking devices" (I presume they meant pot smoking device) in the car, I asked the officer, "O.K. now, If and when you do go out here and search this car for what you presume to be smoking devices, and you find nothing illegal in that car, are you going to come back in here in front of all these people that you are humiliating me in front of, and apologize to me and them for ruining everyones evening? He replied, "No, you need to come with us now!"

At this point my fiancee walked up and said "What is the problem ?, that is my car, if you want to look in it then lets go for God's sake!" The officers,(looking dissapointed) told me " You still need to accompany us outside and stand by!"

We all went outside, the officer opened up the passenger side door, pulled a cologne bottle,(that my fiancee's son had been using) out of the console dash, opened it smelled its contents then put it back in the car and told us we could go back inside. We recieved no apology or anything.

I understand that the Police do have a job to do.But, I do believe that their job is to Serve and protect the public. Not to harass innocent people while they are at one of your hometown returants.

I believe that if the people that are supposed to be there to protect you, turn on you for no other reason than to show their supieriority, shows some underlying hostilities that really need to be addressed before they are unleahed upon the ususpecting residents of the community.
