Police Complaint Center

this is a copy of the report i will file with the local police department but minus the real names i believe nothing will come of it or even be investigated...i fear my family and i will now be "shadowed" by this officer like he does to so many others he feels he doesnt like....im on disability and the local lawers i have called have all but hung up on me in my attempt to seek help what can i do?

What happened

on feb 10 2008 around 8pm my Wife and my kids and I went to My friend and his fiance's home for dinner.
After dinner my friend and I went out side to work on my new cars sterio.I guess it started to get louder than intended because my frinds fieance came out side and informed us it was getting late (i found out later it had been around 10pm) so we turned off the sterio and decided to leave town and go out somewhere with no houses or people around to bother.
As i finished backing out of the driveway and started down the ally my friend and i heard someone yell "HEY" so I stopped the car to see who it was.I could not see anything at first besides the glare of a flashlight then i heard the man say "IS THAT YOUR RADIO" in a loud voice as he slapped his large metal flashlight into the drivers side window of my car.It surprides me and i replied "HEY KEEP THE FLASHLIGHT OFF THE WINDOW".he then screamed at me to "get out of the car" so i opened the door and started to exit the vehicle.i put one foot on the ground and the offending officer then grabbed me by the arm and jerked me from the car and started yelling at me in a similar way a military drill sargent would (nose to nose) with his flashlight now being held like a club (rear end pointed at me)Wearing a grey sweat suit and shoes (no badge,no identifiable police issue anything even no gun) and screaming about people calling him and how i had disturbed people with the sterio and that i was a no good trouble maker.
I felt bad that i had disturbed anyone so i apologised and asked him to stop yelling saying "HEy calm down there is no need to be violent and i am not a trouble maker" and "there is nothing that we cant discuss like normal people" and "if i did wrong im sorry PLEASE stop yelling and talk to me dont yell".This had no effect on the offending officer and he proceded to yell and seem more agrivated than befor in my opinion being unstable and causing me to fear him swinging his flashlight or punching me.
He grabbed me by the arm again and jerked me to the rear of the car saying "get behind the car and dont move you arnt going anywhere" i replied with " I never said i was leaving and i do not plan on going anywhere" but i did ask multiple times if someone could please turn off my ignition in my car (the key and headlight were on and as far as i know if left on will damage the electronic egnition) he replied with a partial smile "NO" i then told him of the damage i was worried about and asked if anyone besides me could to it even him. He replied with " no and i dont give a @#$%" I paced back and forth behind the car in disbeliefe of what was happening and he again grabbed me but this time by the front of my sweatr pulling me closer and again yelling at me about the sterio. I stepped backward out of his grip and said "dont touch me" his eyes then widened and he jumped forward at me screaming " WHY >>>WHAT ARE YOU GOING TO DO HUH..HUH.HUH!!!.I then replied "this is police brutality and i can have your @#$%$#@ badge taken" he then tuerned,took 2 or three steps away,turned again and walked back up to me saying "Ive been an officer for over 20 years no one is going to believe you" by this time i was then angry and fearing i was going to be beaten and started yelling back 1 to calm down and talk not yell 2 yes i admit i was then cussing back. at one point i did tell him if he had been on the force for over 20 years and developed this kind of attitude maby its time not to get another year.
My wife had been watching the entire thing and was scared for ny safty screaming "YOU KEEP YOUR HANDS OFF MY HUSBAND" I was focused on him and didnt catch what else if anything she said.At one point as he screamed i paced back and forth behind the car and he again grabbed me by the back hood of my sweater and pulled very hard choking me and saying "your not going anywhere" even though i had no intension of leaving
I asked him also "am i under arrest or can i just have my dam ticket and get this over with in wich he replied "NO as a matter of fact good idea YOUR under arrest" i was completely dumbfounded at the fact of being arrested because of an accidental noise ordnance breakedge.more yelling back and forth accured with Doug Ulmer continually getting violent and being agressive and both the officer AND I cussed back and forth at each other but i kept my hands at my side as not to lead him in believing he had a right or reason to swing on me.
offending officers Wife came out and told him backup was on the way and handed him his sidearm wich he then clipped on his sweat pants the weight almost pulling his pants down.He then turned his attension back to me and began screaming a deputy was on the way wich made me feel better knowing another officer would be there to possably keep him under control.as we argued back and fourth the other officer pulled in and it was a friendly officer.he stepped from his patrol truck and walked up to us I tried to explain to the friendly officer that i Feared offending officer was loosing controll and i was told to "SHUT UP" by Doug and then offending officer walked the friendly officer Away from me andd i heard him say "this is not the way he was just befor you got here"
the friendly officer and offending officer conversed away from me and i couldnt hear what was being said But i did see him walk up to my fife and tell her if she cussed one more time he would arrest her too but she was not talking to him and not even directing andy comments to him at the time so i do not know why he did it but she tried to walk away to the other end of the property telling him to stop talking to her and just go away but he followed her repeating what he said over and over as if to coax her into saying something he could arrest her on and then Doug and Randy came back to me and Doug was still Irate and Extreamly Volatile.I asked the friendly officer if i was really being arrested or getting a ticke and offending officer replied with "NO YOUR GOING TO JAIL"
the friendly officer asked me if i would please turn around and place my hands behind my back and i complied.I was never read any meranda rights and had then been placed in hand cuffs and put in the passanger seat of the patrol truck.I was too big to keep my hands behind my back and sit back in the seat to secure my seat belt so the friendly officer offered to recuff my hands around front i replied "no im not going to go off or anything i may be mad at the situation but not at you" so he did as he said he would and closed the door.
As i sat in the truck i saw my friend walk up to the two officers and start talking and after about 10 mins officer offending officer Swung open the door and aked if i had heard what they just said i replied "no".offending officer told me they had come to an agreement that i would be taken down to the towns police station and after signing my ticket i would be release as long as i never returned to my friends home with my sterio on and i said "ya know this is all just a learning experiance and the only thing i can do is pay the ticket and learn from it so i dont do it again " offending officer replied saying "NO BOB JUST SHUT UP I KNOW BETTER YOUR TOO DUMB TO LEARN" and slammed the door.
the friendly officer then entered the police truck and drove me to the station.After entering with the friendly officer we sat down and he began to fill out my ticket.offending officer came into the station,sat down next to the friendly officer and watched as Randy wrote the ticket but stopped him at the signing of it and told the friendly officer "No dont sign it i want to do that...i want to be the one to write the report on this" then offending officer took the ticket and it was handed to me to sign so i complied.As i was signing the ticket offending officer started in again on his rant about what i did but i figured it was best not to say anything so i could just hurry and get away from him after i was released.
After signing the ticket i asked if i could go and the friendly officer told me i was free to go so i stood up and i shook the friendly officers hand and said have a good night ...then i turned to offending officer and held out my hand and began to say "im sorry this happened and hop not to end this on bad terms" but was cut off by offending officer telling me no he wouldnt shake my hand and i needed to just get out so i compied.
All of this did not need to happen....if i did wrong i apologise but all it would have taken is for him to tell me what i did and i would never have done it again Or just give me a ticket and explain why ...it was an accident and did not warrent the use of physical force,screaming,cussing or otherwise.Two civilized people should be able to discuss a problem and resolve it peacfully.This has been my first offence of such a charge and is very unlikely to ever happen again and i was very surprised and sorry it happened this time.

the offending officer has falsified his police report and stated that i had tried to "fight him" as well as multiple other false statements....i have 3 witneses that will state otherwise but im afraid that i will be railroaded and im also worried now that the prosicuter may file seperate charges against me because of what the officer lied about.....any suggestions??????

Well here i go to court....so far ive had no help and tried to gather evedence myself.
1 the 911 call my wife made was never recorded due to a "system malfunction"
2 the police cruizer's audio and video was not available due to "system malfunction"
3 my whitnesses are scared and are not willing to help (i also found that the officer has spoken to them)
So here i sit.....i have no other choice but to go in to court knowing im on a loosing battle.....what do i do now?...my right violated,utterly humiliated,my wife feeling the kids and herself are completely unsafe and have no where to turn and me as a father in no position to defend them.
ive begged and pleaded for help in everyway i could and no one wants to uphold justice.what does that say about us as a community and a whole?
as i said befor i go to court now completely defencless and prey i dont get thrown to the dogs so to speak...

Well after having a discussion with the judge i ended up with a 400 dollar fine and 1 year probation with 1 year in jail suspended.
the judge told me that if i had "any more issues including misdemeanors" he would subject me to the full term.
after explaining that i had a new baby in the home he also decided to suspend $300 of the $400 and leave me with the $100.
so in the end i guess i got lucky on the fact the judge was in a good mood and willing to talk.
On the way home the "offending officer" followed me home as soon as he saw me.I predict future problems with the officer and him trying to provoke a problem he can bust me with and im sure he will have a close eye on me.
I plan on finding some way to borrow a video camera for the future problems i predict i will have so that next time i will have it on tape.
now dont misunderstand my words i do not in any way wish to have any issues with this officer and will in no way go out of my way to have any run in's with him so i hope he doesnt fabricate any new stories.

The Idaho State senator and the idaho state legeslator has returned my call about not being read my meranda rights....the legeslator is "personally looking into it" and the senator sent me a letter stateing and i Quote "if you or someone you know has been Improperly treated we need to take some corrective action I stand ready to assist your efforts should you request so" signed personally by the Senator

The reason i was contacted is if you noticed in my statement above i was never read my meranda rights I contacted the idaho state legeslator asking if for some reason they didnt have to read them to me in that situation and the legeslator contacted the senator....i recieved a letter personally signed by the senator and a personal phone call from the legeslator.
Looks like the officer may not get away with his attack on my rights.
I will keep you updated every step of the way.
