Hi. I'm trying to see if I should file a complaint on a CHp officer. My husband was in an accident and the CHP officer felt it was his fault. My husband is Mexican and the CHP was white and the girl in the other car was white. The CHP oficer made some awful remarks to my husband (nothing solandering his race) for example he told my husband are you cold? My husband was shivering because it was about 1 am. He said yes sir it's is pretty cold out here. TThe officer replied that sucks for you! There were numerous other remarks that I felt were uncalled for. He decided to write my husband a ticket for the accident for unsafe speed even though he was not present until after the accident and my husband told him he was going 35-40 mph and the speed limit was 60 (there were no weather conditions either) I think he was just being vendictive. After that he had my husband car towed and the other because my husband's tire poped. Come to find out when we went to pick up my husband's car the CHP officer had it impounded; however the white girl's car was not. Do I have the right to file a complaint? I wanted to make sure that we will not be retaliated against by the officer for filing a complaint- Will we be safe?

I would file the complaint, its really the only way to start the process moving. As far as retaliation ? Well there is only so much that they can do to you and Im guessing once a formal complaint is filed the officer will be a bit more proffesional in his conduct.
